The Zoning Hearing Examiner is part of The Office of Administrative Hearings in the City's Chief Administrative Office.
The Office of Administrative Hearings was created to provide a single site within City government for all administrative hearings required or allowed by statute or ordinance.
Duties
The Office of the Zoning Hearing Examiner conducts monthly quasi-judicial PUBLIC HEARINGS regarding Special Exceptions to the Zoning Code. Please refer to Section 14.16.4.2. of the Comprehensive City Zoning Code.
Applicants may file for a Special Exception for a $145 application fee.
A special exception is the allowance to develop property in a manner different from what is prescribed by a particular zone category. Special exceptions include variances, conditional uses and expansion of non-conforming uses. After a special exception is filed, all interested parties are given the opportunity to participate in a public hearing. Requests are given due consideration toward the final determination of approval, approval with conditions, or denial. Applications for Special Exceptions are available from the Planning Department, on the ground floor, east side Zoning Counter of Plaza del Sol, 600 Second Street NW, Albuquerque, NM 87102 or from the PDF link below.
The Zoning Hearing Examiner will render a determination of approval, approval with conditions, or denial within 15 days after the close of the public hearing. The determination is appealable to the Board of Appeals.
