Obtaining Your Belongings With Law Enforcement Assistance

There are two ways you can have Law Enforcement present to keep you safe while you get your belongings.

Keep the Peace Stand-By

This option may be used for approximately up to 15 minutes for law enforcement to be present to “Keep the Peace” at a location where the calling party needs to collect essential-personal items:

Clothing, toiletries, medications, other items needed or required for day-to-day living; including items needed for work (i.e., specialized tools, etc.) that either party does not dispute. Personal documents (ID’s, birth certificate, etc.)

How to get a Keep the Peace stand-by?

  • Do you need to have an emergency restraining order, temporary restraining order, civil restraining order, or order of protection?
    • No. Having one of the above in place is preferred, but not necessary.
  • Call non-emergency dispatch:
    • Is the location where you need to go in the county or city limits?
      • County (BCSO)- Non-Emergency Dispatch 505-798-7000
      • City (APD) – Non-Emergency Dispatch 505-242-COPS (505-242-2677)
  • Tell dispatch that you need deputies/officers to assist you for a Keep the Peace stand-by to collect your personal-essential belongings from requested address.
    • Be near the location you need to have law enforcement meet you. (Safety first! Park down the street, around the corner, etc. Approach the location once law enforcement is arriving)
    • Tell dispatch where you will be waiting.

Please note there may be an extended wait time depending on the volume of calls for service.

Minute Order (Extend Stand-By)

This option is needed when you need more than 15 minutes, and need to collect more than essential personal items (i.e., moving multiple items, furniture,  large items, need moving trucks, need individuals to help you move, etc.) BCSO handles both county and city areas.

How to get a Minute Order?

A court order is needed. This may be obtained after the hearing for a temporary restraining order.

  • File a blank motion at the Domestic Violence office at 2nd Judicial District Court
  • This order needs to be detailed- Ask for “Bernalillo County Sheriff’s deputies to assist”:
    • List date Deputies will schedule based on availability of the Civil Process Division M-F, 7am-3pm.
    • Include preferred date options.
    • List preferred time frame (Ex. Up to two hours, up to four hours, etc.)
    • List start time (Deputies will schedule as stated above. Include preferred start time)
    • Exact address deputies are to assist you at (Do not forget unit, space, apartment #)
    • Detailed list of items you would like to take. This needs to be detailed! If an item is not on your list that was signed by the judge, and the other party is  disputing you taking it, deputies cannot authorize you to take the item in question if not listed.
  • Do you need “proof of ownership?” This is helpful, but not required (receipts, serial numbers, titles, statements, pictures, agreements, etc.)

Once signed by the judge, take the order to BCSO Civil Division at 415 Silver Ave NW

Please allow at least few days for scheduling, this will not be the same day.
