Proposed Amendments to the Regulation Governing the Issuance of Fines and Timeliness of Community Service Pursuant to the Albuquerque Automated Speed Enforcement Ordinance
Notice is hereby given that the Department of Municipal Development ("DMD") will conduct a public hearing on the rule described below.
When: July 8, 2026, at 11:00 a.m.
Where: Hearing Room on the basement floor of Plaza Del Sol, 600 2nd St. NW, Albuquerque, NM 87102
The purpose of this meeting is to obtain public input on the City's proposed amendments to the Regulation Governing the Issuance of Fines and Timeliness of Community Service Pursuant to the Albuquerque Automated Speed Enforcement Ordinance ("Regulation"). The amendments provide clarity on the existing procedure to appeal Automated Speed Enforcement system fine notices. The Regulation clarifies that:
- The hearing officer shall not issue equitable relief or otherwise adjudicate the appeal of an ASE System Fine on the basis of equity.
- If the hearing officer finds that an ASE violation, as defined in ROA 1994, Section 7-15-3, has occurred and finds that the appellant has not asserted an applicable and legally recognized defense, the hearing officer shall uphold the ASE System Fine;
- An appellant's history of traffic citations and/or ASE system fines, or lack thereof, shall not constitute a defense to an ASE violation; and
- The reason an appellant was speeding at the time the ASE violation was recorded shall not constitute a defense to an ASE violation. This does not include emergency vehicles responding to an emergency.
- The term "Emergency Vehicle" is defined as a vehicle used by emergency services including, but not limited to, Albuquerque Police Department vehicles, Albuquerque Fire Rescue vehicles, and ambulances.
The public hearing allows members of the public an opportunity to submit testimony and arguments on the Regulation.
