The Office of the City Clerk hereby gives notice that it will conduct a public hearing on the described rules below:
Proposed Rule: Rules Governing the City of Albuquerque Independent Hearing Office (IHO).

The purpose of this hearing is to obtain public input on the proposed amended rules for Administrative Hearings. The proposed amendments to the IHO Rules introduce several key updates. They establish new oversight measures for the Chief Hearing Officer, requiring an annual performance evaluation by the City Clerk while formally affirming the Hearing Officer's decisional independence. They also include a new jurisdiction section expressly limits the IHO's authority to hearing types listed on the City Clerk’s website and creates a process for appealing jurisdictional disputes.
The amendments also add a dedicated section governing Automated Speed Enforcement (ASE) appeals, which narrows available defenses to those specifically enumerated by ordinance. Finally, a new reconsideration process sets 7-day deadlines for filing and responding to motions, prohibits introducing new evidence or re-arguing previously decided issues, and clarifies that filing a motion does not extend the underlying appeal deadline.
The public hearing allows members of the public an opportunity to submit testimony and arguments in person on the proposed rule above.
