Notice is hereby given that the Environmental Health Department will conduct a public hearing on Thursday, May 21, 2026, from 9:00 a.m. to 12:00 p.m. on the rules described below.

NOTICE OF PROPOSED RULEMAKING

Notice is hereby given that the Environmental Health Department will conduct a public hearing on the proposed 2024 Rules of the City of Albuquerque Food Service and Retail Ordinance. 

Proposed Rule:  Food Service and Retail Ordinance Amendment

WHEN: Tuesday, May 21, 2026 at 9:00 A.M. till 12:00 P.M.

WHERE: Vincent Griego Council Chambers, basement level of the City of Albuquerque Government Center, 1 Civic Plaza NW, Albuquerque, NM 87102

The purpose of this meeting is to obtain public input on the proposed regulation amendment 2024 Rules of the City of Albuquerque Food Service and Retail Ordinance. The purpose of the new regulation is to provide the City of Albuquerque Food Service and Retail Ordinance §9-6-1 et seq with:

  • Incorporation of the permit classification “Micro-Market” to facilitate and support the ABQ Fresh initiative;
  • Correct grammar and formatting issues throughout the document to create clarity and/or consistency throughout the document and other City ordinances;
  • Adjust protocols for the issuance of permits to allow for a smoother process;
  • Clarify regulations related to allergen warnings, temperature holding, date marking, and food transportation;
  • Include language specific to the prohibition of Kratom and other non “Generally Recognized as Safe” ingredients;
  • Include clarifying language on Cannabis Permits;
  • Include clarifying language on grade stickers; and
  • Add in language to address advanced vending machines.
