Public Comment: The AQCB will take general public comment during the public comment opportunity. Please sign up to speak using the chat function or raise your hand when the Chair asks for public comment. If you are calling in, please press *9 to raise your hand. Any disruptive conduct may result in removal from the meeting.

Public comment is generally limited to 5 minutes per person. Commenters will be called in the order they signed up. Time starts when you start speaking. Additionally, you can email comments to [email protected] up until 2 hours before the meeting.

A. Hearing regarding AQCB 2025-01: Petition to Amend Existing Rule 20.11.8 NMAC- Ambient Air Quality Standards to update the summary table (Allen Smith, Regulation Development Coordinator)

B. AQCB 2025-02: Petition to Repeal and Replace Existing Rule 20.11.20 NMAC- Fugitive Dust Control for a minor technical amendment regarding asbestos (Catalina Lehner, AQ Program Administrator/Planning Manager and Doug Wykstra, Asst. City attorney).

IV. UPDATE

20.11.72 NMAC*- Health, Environment and Equity Impacts (HEEI) (Terrance Smith, EHD Deputy Director)  *New Mexico Administrative Code

VI. CLOSED SESSION

The Board will consider whether or not to go into closed session with the Board Attorney to discuss pending litigation:

NTESS v. Air Board (A-1-CA-41666); Air Board v. COA (D-202-CV-2023-09295)  

GCC v. Air Board (D-202-CV-2023-09435)

• The board will make a motion, with reasonable specificity, and vote whether or not to go into closed session following procedures in Section 10-15-1 (I) of the OMA.
• If there is a closed session, the Board will announce what was discussed and will make any motions based on the closed session discussion. Topics discussed during a closed session are limited to those expressly excepted from the open meeting requirements in Section 10-15-1 (H).
