Air Board Public Notices and Comment Opportunities

This page presents a list of current and past public notices and opportunities for public comment on air quality petitions considered by the Air Quality Control Board, as well as any associated legal ads.

Current Rulemaking Notices

As of November 21, 2022, the Air Board is in receipt of a petition to amend Title 20, Chapter 11 of the New Mexico Administrative Code to require review and consideration of health, environment and equity impacts in air quality permitting decisions. In the Matter of the Petition to Amend Title 20, Chapter 11 of the New Mexico Administrative Code to Require Review and Consideration of Health, Environment and Equity Impacts

Pursuant to 20.11.82.18(C) NMAC, the Board shall decide whether to hold a hearing on the proposed regulatory change at a public meeting occurring no more than 60 days after receipt of the petition. Any person may respond to the petition either in writing before the public meeting or in person at the public meeting. Notice of the date, time and location of Air Board meetings and either a copy of the agenda or information on how the agenda can be obtained is provided on the Board's website at https://www.cabq.gov/airquality/air-quality-control-board/events.

  • Draft 2019 Regional Sulfur Dioxide Emissions and Milestone Report
    • Description: This draft report proposes to determine that 2019 emissions of sulfur dioxide from applicable sources in New Mexico (including Albuquerque - Bernalillo County), Utah, and Wyoming were lower than a regional milestone established in the Regional Haze State Implementation Plans of these three states, as provided in 40 CFR Part 51, Section 309.
