Short Term Rental Permit

The Short Term Rental (STR) Ordinance went into effect on April 23, 2021. Permit applications are submitted via the STR website. STR operators can remit Lodging Taxes and Hospitality Fees via the same website. The City of Albuquerque works with LodgingRevs for provision of the website for the permits and tax and fee collection, with compliance and enforcement, and in providing a 24/7 emergency hotline that will take calls about complaints and concerns from the general public as well as guests at an STR.

Legislation

O-20-30, the Short Term Rental bill, passed in the City Council meeting on October 5th, 2020 and was published on October 23rd, 2020. The ordinance went into effect on April 23rd, 2021.  

A STR is a rental in a dwelling unit of 29 days or less, and a STR operator is the owner or party responsible for an STR property or properties. The ordinance requires each STR operator to have a valid STR permit for each STR property. Additionally, the ordinance lays out the following requirements for the permit:

  • Include a statement that the owner and operator will comply with all applicable City ordinances
  • Include a “Good Neighbor Agreement” that will be posted inside each unit to inform guests of applicable City Ordinances (like noise, litter, parking).
  • Limit overnight STR occupancy to 2 adults (over 12 years old) per bedroom
  • Require provision of proof of short term rental insurance
  • Limit gatherings to two times the maximum overnight occupancy, but no more than 20
  • Require gatherings of more than the overnight occupancy to disperse by 10:00pm local time
  • The permit comes with a fee of $120 (first year) and an annual renewal fee of $90 (second and following years)

Background

A short term rental is commonly defined as a rental in a single family residence or apartment of 29 days or less.  In recent years short term rentals have increased in Albuquerque and across the country. Short term rentals bring with them both benefits and challenges. Different communities across the country have taken a variety of different approaches to try to manage the impacts of short term rentals. In response to concerns within the community about Short Term Rentals and in order to take a comprehensive look at the best practices across the country (as relevant to Albuquerque); Councilor Gibson established the Short Term Rental Task Force (via R-18-49) in order to consider:

  • Options for registration of short term rentals.
  • Options for regulation of short term rentals to address concerns about safety, nuisance, and compatibility.
  • Options for the City to collect appropriate registration fees and lodging taxes.
  • Any other relevant and helpful options relating to this issue. 

The Task Force is comprised of a mix of public officials, community members, and representatives from relevant industries.

In response to the recommendations of the Short Term Rental (STR) Task Force, Councilor Gibson is proposed to require a permit for Short Term Rentals in Albuquerque. This bill, O-20-30, was on the Letter of Introduction at Monday, August 17, 2020 City Council Meeting and was referred to the September 14, 2020 Finance and Government Operations Committee Meeting. The bill follows the recommendations of the STR Task Force, see below for a comparison table of the STR Task Force recommendations and the bill, a link to the bill, and the Fiscal Impact Analysis (FIA). The FIA was requested during the drafting of the bill in order to inform the proposed permitting fee amount.

Public Meeting

On Tuesday March 19th, 2019, Councilor Gibson and the Short Term Rental Task Force held a public meeting regarding Short Term Rentals in Albuquerque. The meeting was held from 6:00 – 8:00 p.m. at the REALTOR® Bldg., Greater Albuquerque Association of REALTORS®, 1635 University Blvd. NE, 87102. The meeting provided an opportunity for the public to learn about what the Short Term Rental Task Force has been considering and for the Short Term Rental Task Force to get public input on what the task force has discussed and considered regarding the regulation, registration, and administration of Short Term Rentals in Albuquerque.
