Notice of Availability of Medical Monitoring

Pursuant to the Settlement Agreement entered between the City of Albuquerque and New Mexico Occupational Health and Safety Bureau, the City is offering medical monitoring for eligible individuals who were in the construction area of the women’s shelter in the Gateway Center between April 2022 through March 2023 and may have been exposed to asbestos containing materials (“ACM”).
In order to be eligible, the City is considering the dates the individual was present in the construction area, duration of time in that area, and reasonable proof an individual was located in this area during the time claimed. Individuals shall be deemed eligible for medical monitoring if they can show they were present in the construction area or the adjacent hallways of Phase 1 (the women’s shelter) on the Second Floor of the Gateway Center for five (5) or more days. This area is in the center of the second floor of the Gateway Center, west of the main entryway that has escalators to the second floor. An image showing the applicable area is below. During the applicable timeframe, the relevant area was clearly marked as a construction zone. The City will evaluate any other individuals who wish to be considered for medical monitoring on a case-by-case basis.
