Eligibility Requirements

Employees who meet applicable eligibility requirements are encouraged to utilize available leave and workplace accommodation benefits, including FMLA, when appropriate. However, participation in such entitlements is voluntary, and employees should apply only if they feel their circumstances require it. The information below is intended to help provide a better understanding regarding eligibility requirements, as defined under the FMLA:


In order to be eligible for FMLA leave, an employee must have:

  • 12 months of service as a City employee.
    • The 12 months of employment are not required to be consecutive in order to qualify for FMLA.
    • In general, employment at the City within the last 7 years, even with a break in service, is counted toward the service length requirement.
  • 1,250 hours worked within the last 12 months from the date the request is submitted.
    • Hours worked means regular, clocked-in, working hours
    • Paid sick, vacation, and compensatory leave accruals utilized within the request period will count against the 1,250-working-hours requirement.
    • Military Leave and some leave related to Union activities may be counted toward the 1,250-working-hours requirement.
