Instructions for Handling a Photo Enforced Violation |
When you receive a Automated
Photo Enforcement notice of violation, there
are several options for resolving the
charge. They are as follows:
Each notice of violation will have a due
date, a hearing must be scheduled or payment
received by that due date. |

Paying Photo Enforcement
Notices of
Violation by Mail |
Each Automated Photo Enforcement notice of violation has a fine amount that
must be paid in full or a hearing request
must be received on or before the due date. The notice of violation will state the
amount of fine that is due. You can pay the
amount due by following the instructions on the
notice.
Along with your payment, you must return option C of the notice
of violation. Also, please be sure to include your notice
of violation number on your check or money order to ensure timely
processing. Make checks or money orders payable to "Photo
STOP." A $50.00 administrative fee will be assessed for
rejected or declined payments.

You may pay your notice of
violation on-line and also view a short video of
the violation at
www.photonotice.com City code is
ABQ. A video is not
available for any notice of violation
beginning with the letters "AV."

Requesting a Hearing to Contest a Notice of
Violation |
You may request a hearing to
contest your notice of violation. To
request a hearing, complete option B of the
notice of violation. Mail this request
for hearing to:

To avoid delays, we recommend that you
request a hearing by mail. Please review the
video of the violation on-line if possible. We
sometimes find that folks who do not think they
committed a violation change their mind when they
see the video.
To avoid a delinquency notice and any additional
costs, your request for a hearing (option B) must be received by the
due date indicated on your
notice of violation. You will be notified by mail of
your hearing date. You must appear for your
hearing on the date and time assigned. At that time you will be
given the opportunity to testify and to present any
evidence to the city.
If you fail to respond to this notice of
violation,
you will be subject to additional fines, a default judgment may be
entered against you, and/or your vehicle is
subject to seizure until all fines are paid. |

| Solving
Matters Regarding the
Driver/Owner of the Vehicle |
Automated enforcement violations are enforced
the same way parking tickets are enforced. The
registered owner, or owners, of the vehicle are
responsible without regard to whether they were
actually driving at the time of the infraction.
If you are a person or company that owns a fleet,
rents cars or otherwise lets other people use your
car, you can name the person who was actually
driving during the time of the violation. You
do this by exercising option A on the notice of
violation. If the named party does not pay,
the registered owner is still responsible. |

Troubleshooting |
You should make sure the New Mexico Department of
Motor Vehicles has your current address. If
you have moved and did not provide the DMV
with your new address, then you may not receive the
notice of violation or may not receive it on time.
Keep in mind, you are still responsible.
Make sure you mail payment (option C), identify
driver (option A) or
request a hearing (option B) at least three days
before the due date. If you put it in the mail
the day it is due, you will be delinquent. |
