R-16-13- Adopting The East Gateway Metropolitan Redevelopment Area Plan

This Resolution would adopt an East Gateway Metropolitan Development Plan for the existing East Gateway Metropolitan Development Area. The purpose of the Plan is to revitalize parcels along Central Avenue, from Wyoming to Four Hills Rd, creating a more welcoming corridor for residents and visitors. This bill will be heard by the LUPZ committee on March 16th at 5:00. The project website can be found here.

Legislation I Recently Introduced

O-15-1 - Amending The Safety In Public Places Ordinance

The intention of this bill is to protect the safety of both pedestrian and vehicular traffic. 
This would limit pedestrians from panhandling in dangerous spaces such as:

  • Street medians
  • Within traffic lanes
  • Within 10 feet from a traffic lane where there is no sidewalk or other intended access for pedestrians
  • Within 100 feet of any interstate access ramp
  • Along a roadway with a speed limit in excess of 35mph

We have met with the ACLU concerning this ordinance, as they are concerned with us violating freedom of speech rights. We will continue to work with all entities to ensure we produce legislation that will uphold at full council and the Supreme Court.

O-16-11 - Vacant Commercial Building Ordinance

Here are the basics of what this ordinance would do:

  • Add a new section to the Building and Safety section of the Code of Ordinances called the “Vacant Commercial Buildings Ordinance”
  • Require registration of vacant buildings with the City (with a fee), renewal required every 6 months as long as the building remains vacant
  • Require an authorized local agent to receive notices of code violation or other enforcement proceedings on behalf of non-resident owners
  • Require liability insurance of not less than $1M to cover injury to persons or property caused by the physical condition of the building
  • Require active maintenance, securing and monitoring of vacant non-residential structures by the property owner or agent
  • Limit boarded-up windows and doors to a period of 180 days in a year
  • Require removal of graffiti within 48 hours of placement on the property

This ordinance will go to the Environmental Planning Commission (EPC), from there it will be heard at Land Use, Planning, and Zoning Committee (LUPZ), before it is heard at full council.
