Protection/Constitutional Rights

Intimidation, harassment, and stalking are crimes. If you are being intimidated, harassed or stalked, or if you feel you are in danger at any time, please call 911. Also, you may be able to get a restraining order.

Crimes in Violation of Constitutional Rights

• Murder: 1st and 2nd degree
• Manslaughter
• Criminally negligent homicide and vehicular homicide
• Assault: 1st, 2nd, and 3rd degree, vehicular, on the elderly or handicapped
• Menacing
• Kidnapping: 1st and 2nd degree
• Sexual Assault: 1st, 2nd, and 3rd degree, on a child by one in a position of trust
• Abuse or neglect of the elderly or handicapped
• Harassment and stalking
• Incest: aggravated incest, child abuse
• Sexual exploitation of children
• Crimes against at-risk adults
• Any crime which includes an act of domestic violence

Getting a Restraining Order

With a restraining order, a judge orders a person to have no contact with you. Once it is in place, if the person contacts you, they may be arrested. To get information on how to get a restraining order, call 841-6737.

The Office of the Special Commissioner is located on the second floor (Room 224) of the Bernalillo County Courthouse, 400 Lomas NW.
Bring a valid New Mexico Driver's license or New Mexico picture ID. Do not bring children to the courthouse.
