The ZBOA consists of five members.

Function

The Zoning Board of Appeals (ZBOA) was established by City Ordinance and is the appellate committee responsible for hearing appeals of Zoning Hearing Examiner decisions on special exceptions to the Zoning Ordinance.

The Zoning Ordinance establishes three types of special exceptions:
(1)conditional uses in various Zoning Districts (“Zones”), (2) variances from the strict literal interpretation of the provisions of the Zoning Ordinance, and (3) expansion of Non-Conforming Uses.

The Board may only consider evidence in the record of hearing of the Zoning Hearing Examiner. Appeals of Board of Appeal decisions are heard by the City Council.

General Meeting Information

The ZBOA hosts hearings on the fourth Tuesday of each month in the Plaza del Sol hearing room at 600 2nd Street NW in downtown Albuquerque. Hearings begin promptly at 9 a.m.

Notice: Free 2-hour parking for Plaza del Sol customers is available on the north side of the building at 600 Second Street NW. This parking lot is monitored by Parking Services - vehicles in the lot for more than 2 hours are subject to fines and or/towing.

Apply To Be A Board Member

The ZBOA is currently accepting applications for new board members. Serving volunteer board members should have general knowledge of the Zoning Code and should not be people likely to have conflicts of interest in cases heard before the board. Board members must also provide a time commitment to public hearings.
