    LAND USE HEARING OFFICER (LUHO) Recommendation (posted 2-5-13)

    • AC-12-17 (posted 2-5-13) - Proposed Walmart - Montano and Coors
        • The City Council will consider to accept or reject the LUHO’s recommendation on Monday, March 4, 2013 at their normal City Council meeting.
        • The appeal itself will not be heard and there is no opportunity for public comment.
        • If the City Council accepts the LUHO’s recommendation, the appeal is concluded.
        • If the City Council rejects the LUHO’s recommendation, the City Council will schedule to hear the appeal at a future date.

          NOTICE OF APPEAL

          On November 2, 2012, the Planning Department received an appeal of the EPC’s decision to deny the proposed Walmart at Coors and Montano NW. Planning Staff will prepare a City Council packet over the next 2-3 weeks that will include the entire record of the EPC case and a response to the appeal. The appeal will most likely be introduced to the City Council in early December 2012, who will then refer the appeal to the Land Use Hearing Officer for a hearing.

          • Appeal for EPC case 11EPC-30067 and 11EPC-40068 will be heard by the Land Use Hearing Officer at 9:00 a.m. Friday, December 21, 2012 in the Vincent Griego City Council Chambers, Basement Level, Albuquerque/Bernalillo County Government Center, One Civic Plaza . No public comment, new evidence or testimony will be allowed at this appeal hearing.  Parking fees will not be waived.
