July 24, 2019 Air Quality Third Public Information Hearing for New Mexico Terminal Services, LLC.

The Air Quality Program has RESCHEDULED the June 27, 2019 Third Public Information Hearing (third hearing) for New Mexico Terminal Services, LLC for the Construction Permit Application #3340. THE THIRD PUBLIC INFORMATION HEARING HAS BEEN RESCHEDULED TO JULY 24, 2019.

The Program previously held a hearing for this application on August 30, 2018 and issued a permit on September 19, 2018.  On October 26, 2018, certain petitioners requested a hearing before the Albuquerque-Bernalillo County Air Quality Control Board (Air Board) regarding the permit.  In preparing the Administrative Record, the Program realized that it had not published the public notice for the August 30, 2018 hearing in the newspaper as required.  The Program informed the petitioners and the permittee of this issue and requested that the Air Board reverse and remand the permit to the Program for further processing.  The Air Board issued an order reversing and remanding the permit to the Program on February 22, 2019. 

The Program published the notice for the second public information hearing in the newspaper on March 24, 2019 and the second hearing was held on April 24, 2019.  However, the second notice contained an erroneous day of the week for the second hearing (e.g. “Thursday April 24, 2019” when April 24 was a Wednesday). The Program is holding a third hearing to assure that the public is given clear notice of the date and time.  This public notice informs the public of the date and time of this third hearing, and informs the public how to obtain additional information or comment, if desired.
