The Air Quality Control Board (Air Board) will conduct a motion hearing in the matter of AQCB Petition No. 2014-4 on June 30, 2015. The hearing will begin at 5:30 p.m. in the Vincent E. Griego Chambers, Albuquerque-Bernalillo County Government Center, One Civic Plaza NW Albuquerque, NM 87102. The Air Board will hear the City of Albuquerque’s’s Motion and Brief to Resolve the Merits of the Petition Using Summary Procedures or, in the Alternative, by Summary Judgment; as well as any responses to Dispositive Motions that may have been filed by that date.
Parties and representatives are as follows – Petitioners: Jon Block and Eric Jantz, New Mexico Environmental Law Center, on behalf of SouthWest Organizing Project [SWOP], by Juan Reynosa, Environmental Justice Organizer, and Esther and Steven Abeyta, Members of SWOP; Respondents: for City of Albuquerque, Carol Parker, Assistant City Attorney and Danny Nevarez, Air Quality Program, Deputy Director, Environmental Health Department; Permittee: Rod Honstein, Honstein Oil & Distributing, LLC.
Hearings and meetings of the Air Board are open to the public and all interested persons are encouraged to participate. All persons who wish to testify regarding the subject of the hearing will be given a reasonable opportunity to submit relevant evidence, data, views, and arguments, orally or in writing, to introduce exhibits and to examine witnesses in accordance with the City of Albuquerque Joint Air Quality Control Board Ordinance Section 9-5-1-7 ROA 1994; Bernalillo County Ordinances Sec. 30-36; and 20.11.81 NMAC Adjudicatory Procedures – Air Quality Control Board.
